Weis' "Ancestral Roots . . ." (155:18), (240:18a). Stuart's "Royalty For Commoners" (206:38) refers to him as "the Burgundian opponent of the Capets". In the early 880s, his brother, BOSON, king of Provence, made him count of Autun. By 890, Richard, who, by then, was known by his nickname, "The Justiciar" was also master of Sens, Auxerre, and Troyes. This was the Frankish portion of the ancient kingdom of Burgundy and was destined to become the Duchy of Burgundy under the Capetian kings of France.

The continual fracturing of the Frankish Empire lead to an independent Burgundian kingdom, as the previous Burgundian territory was split in two, the second half forming a duchy. Boso was the ruler of the Kingdom of Burgundy, and his brother, Richard, was the first Duke of the other half of Burgundy.

The Duchy of Burgundy began when part of the Kingdom of Burgundy was detached and assigned to France (West Francia). This was part of the Treaty of Ribemont by which the young Kings of France, Louis III and Carloman II, were deprived of most of Lorraine.
